Welcome to High Desert Doppler. Please read these Terms and Conditions (“Terms”) carefully before using the website, phone, text, online bill pay, or scheduling services (collectively, the “Services”) offered by High Desert Doppler (“High Desert Doppler,” “we,” “us,” or “our”), a mobile and in-clinic diagnostic imaging provider serving Albuquerque, Santa Fe, Rio Rancho, Los Lunas, Belen, Las Cruces, and the surrounding New Mexico area. By accessing our website, calling our office, texting us, using our online bill pay, or scheduling an appointment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Services.

 

 

 

1. Our Services

 

High Desert Doppler provides mobile and in-clinic diagnostic ultrasound, Doppler, vascular, echocardiography, and X-ray imaging services. Our Services include general information about our practice, appointment scheduling (by phone, automated voice assistant, text, or website), online bill pay, and communication regarding your visit.

 

High Desert Doppler does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

 

 

 

2. Eligibility

 

You must be at least 18 years of age, or the applicable legal age of majority in your jurisdiction, to use our Services on your own behalf. If you are scheduling, communicating, or paying on behalf of a minor or another individual, you represent that you are their parent, legal guardian, or otherwise authorized to act on their behalf.

 

 

 

3. Not Medical Advice

 

Information on our website and provided by our staff or automated assistant is for general informational and scheduling purposes only. It is not medical advice, does not create a physician-patient or provider-patient relationship, and should not be relied upon as a substitute for professional medical judgment. Diagnostic results and interpretation are provided through your care team and referring physician in accordance with applicable clinical and regulatory standards.

 

 

 

4. Automated Voice Assistant and Communications

 

When you call our office, your call may be answered in whole or in part by our automated voice assistant, “Jess,” which can collect scheduling information and book certain appointment types. Calls may be recorded or transcribed. Some requests are routed to a live staff member for callback, including certain exam types, mobile/in-home visits, and urgent matters.

 

By using our phone, text, or online scheduling Services, you agree that:

 

  • You will provide accurate and current information (including your name, date of birth, exam type requested, insurance information, and referring facility)
  • We may contact you by phone, text message, or email regarding your appointment, using the contact information you provide
  • Calls may be recorded for scheduling accuracy, quality assurance, and training purposes
  • Electronic communications, including phone, email, and text messaging, may not be fully secure, and you accept the risk that such communications could be accessed by unauthorized parties

 

 

 

5. SMS Messaging Program — Mobile Terms of Service

 

Program Name: High Desert Doppler SMS Appointment Program.

 

Program Description: By opting in, you agree to receive text messages from High Desert Doppler related to appointment confirmations, reminders, rescheduling, and responses to inquiries you initiate. This Program is transactional/informational in nature and is not used for unrelated third-party marketing.

 

Opt-In: You may opt in by providing your mobile number during a phone call (including calls handled by our automated assistant, Jess), by texting our number, or by submitting your mobile number through a website or booking form and affirmatively agreeing to receive messages. Consent to receive SMS messages is not required to obtain any service from High Desert Doppler.

 

Message Frequency: Message frequency varies depending on your scheduling activity.

 

Cost: Message and data rates may apply. Charges depend on your mobile carrier and plan.

 

Opt-Out: You can cancel this SMS Program at any time. Text “STOP” to the number messaging you. After you send “STOP,” we will confirm your unsubscribe status via SMS, and you will receive no further messages unless you opt in again.

 

Rejoining: If you want to rejoin the Program, text “START” to the number that previously messaged you, or contact our office at (505) 350-3397, and we will resume sending SMS messages to you.

 

Help: If you experience issues with the Program, text “HELP” or contact us directly at (505) 350-3397 or highdesertdoppler@gmail.com.

 

Carrier Liability: Carriers, including wireless carriers, are not liable for delayed or undelivered messages. This Program is supported by major US wireless carriers; carrier coverage and reliability are not guaranteed by High Desert Doppler.

 

Privacy: Your privacy is important to us. For information on how we collect, use, and protect your information — including our commitment not to share your mobile opt-in information with third parties for marketing purposes — please review our Privacy Policy, which is incorporated into these Terms by reference.

 

Compliance with Industry Standards: This Program is operated in accordance with CTIA guidelines and applicable wireless carrier requirements for SMS/MMS messaging programs, including the CTIA Short Code Monitoring Handbook and 10DLC messaging standards.

 

Legal Compliance Note: This Program is intended to comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act (where applicable), and other applicable federal and New Mexico state laws governing text message communications.

 

 

 

6. Appointment Scheduling, Rescheduling, and Cancellations

 

Appointments booked by phone, our automated assistant, text, or website are subject to confirmation by our staff. For paid appointments, fees may apply for cancellations, rescheduling, or no-shows occurring within 24 hours of the scheduled appointment time. Please contact our office at (505) 350-3397 as soon as possible if you need to cancel or reschedule. We reserve the right to reschedule appointments due to equipment availability, technician availability, or other operational needs, and will make reasonable efforts to notify you promptly.

 

 

 

7. Insurance, Billing, and Payment

 

You are responsible for providing accurate insurance information and for verifying your own coverage, benefits, and any applicable referral requirements prior to your appointment. High Desert Doppler is not responsible for coverage denials resulting from inaccurate information provided by the patient or referring facility.

 

Payment is due for patient balances, co-pays, deductibles, coinsurance, and any other amounts not covered by insurance. Patients may pay their bill online through the secure PayTrace payment link provided on the High Desert Doppler website. Insurance may be accepted where applicable, but patients remain responsible for any unpaid balance after insurance processing. For questions about billing, payment amounts, insurance, refunds, or disputes, patients should contact the office directly at (505) 350-3397.

 

Online Bill Pay: Our website provides an online bill pay option through PayTrace, a third-party payment processor. Payment card information you submit through this portal is handled by PayTrace in accordance with its own security standards; High Desert Doppler does not directly store your full payment card information.

 

 

 

8. Medical Records Requests

 

Requests for copies of imaging results, reports, or medical records are handled in accordance with our HIPAA Notice of Privacy Practices and applicable New Mexico and federal law. A reasonable, cost-based fee permitted under New Mexico law may apply to certain record requests. Please contact our office directly to initiate a records request.

 

 

 

9. Accuracy of Information You Provide

 

You agree to provide truthful, accurate, and current information when scheduling an appointment or communicating with our staff or automated assistant, including your identity, date of birth, and insurance details. Providing false or misleading information may delay or affect your care and billing.

 

 

 

10. Website Use, Content, and Intellectual Property

 

All content on our website — including text, images, logos, trademarks, and the High Desert Doppler name and branding — is owned by or licensed to High Desert Doppler and is protected by applicable intellectual property laws. You may view, download, and print website content solely for your own personal, non-commercial use in connection with scheduling or learning about our Services. You agree not to copy, reproduce, distribute, scrape, or create derivative works from our website content, or attempt to gain unauthorized access to our website, phone systems, or CRM, without our prior written consent.

 

 

 

11. Third-Party Services

 

Our scheduling, phone, SMS, billing, and customer relationship management functions are supported by third-party platforms, including our CRM/marketing platform (GoHighLevel), our payment processor, and underlying telecommunications and messaging carriers. Message and payment processing delivery is not guaranteed and depends on factors outside our control. We are not responsible for outages, delays, or errors arising from these third-party services that are outside our reasonable control. Use of any third-party platform linked from our website is subject to that platform’s own terms and privacy policy.

 

 

 

12. Limitation of Liability

 

To the fullest extent permitted by law, High Desert Doppler and its owners, staff, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website, phone, text, billing, or scheduling Services, including errors made by our automated voice assistant, missed appointments, or communication delays. This limitation does not apply to liability for clinical care, which is governed separately by applicable healthcare standards of care and law.

 

 

 

13. Indemnification

 

You agree to indemnify and hold harmless High Desert Doppler and its owners, staff, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of our Services, violation of these Terms, or provision of false or inaccurate information to us.

 

 

 

14. Disclaimer of Warranties

 

Our website and Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to accuracy, reliability, or availability of our automated scheduling assistant, website, or online bill pay portal.

 

 

 

15. Governing Law and Venue

 

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of our Services shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the jurisdiction of those courts.

 

 

 

16. Severability and Entire Agreement

 

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and HIPAA Notice of Privacy Practices, constitute the entire agreement between you and High Desert Doppler regarding use of our Services.

 

 

 

17. Changes to These Terms

 

We may update these Terms from time to time. The “Effective Date” above reflects the most recent revision. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
